The ‘patent box’ tax incentive is designed to encourage medical, biotech, agricultural, veterinary and low emissions innovation to the extent R&D occurred in Australia:

• Income from Australian owned medical, biotech, agricultural, low emissions and veterinary patents (developed locally) taxed at 17% (as opposed to 30% or 25% for SMEs)
• Concessional tax treatment also applies to: commercialising eligible payments linked to agricultural and veterinary chemical products listed on either: -  Australian Pesticides and Veterinary Medicines Authority - PubCRIS register - eligible Plant Breeder’s Rights 
• Commercialising patented technologies which have  potential to lower emissions as set out in the 140 technology areas listed in Government’s 2020 Technology and Investment Roadmap, or included as priority technologies and future annual Low Emissions Technology Statements
• Finalisation of “patent box” expansion to agriculture is subject to industry consultation.
